1. Your Use Generally

Your use of the Website confirms your acceptance of these terms and conditions and your agreement to be bound by them. Please also review Use of this site, Ownership and Trademarks.

2. Prices

All prices include a 20,00% VAT.
You will not incur any extra charges except those clearly indicated in the total amount of your shopping basket. Our goods  are always sent duty free within the EU. You may have to pay custom duties if you reside outside the EU. The actual value of the duties to be paid will be determined by the custom officials. The task of collecting  custom duties will be entrusted with the courier.
We reserve the right to make changes in information about price, description, and/or availability without notice. We reserve the right without prior notice, to limit the order quantity on any product and/or refuse service to any customer. Please always check prices before ordering.

3. Payments

You can choose amongst the following options:
•    VISA, Mastercard, American Express, Discover, Bank. No extra charges apply.
•    Paypal. No extra charges apply.

The processing of your order starts once we receive confirmation of your payment. If you pay via credit card the amount of your purchase will be withdrawn directly from your credit card account.
We do not process nor store any of your personal financial data. In order to guarantee maximum security everything is taken care of by Paypal, the industry leading company (see privacy for more information).

4. Products

We have made every effort to display as accurately as possible the colours and textures of our products that appear on this Website; however, the actual colours and textures you will see will depend on your computer, and we cannot guarantee that your screen will accurately display our colours and textures.
All our fabrics are 100% cotton. Please refer to Quality as for fabric specifications and tailoring methods.

5. Measurements and styles

All our products are made according to the measurements and preferences that you submit.
You can choose amongst one of the following options:

•    Provide us your body measurements
In the first case we take care of adding some extra cm of fabric to your data according to the fit that you choose, in order to give you room to move about. You can choose between a Slim fit, a Formal fit and a Loose fit (click here for explanations). Correct measurements and the style that you choose are very important in terms of the final result, so please make sure to insert the correct values and to choose the style that fits you best before ordering.

•    Provide us the measurements of one of your shirts that fits you well
If you choose the shirt measurement option you will receive a new shirt equal to the original one. However, we cannot guarantee that design and looks will be identical to your original one and that it will be a perfect fit. The looks obviously depend also on the fabric and other details that you choose.

•    Choose from one of our standard sizes (we do not recommend this option)
 If you choose from one of our standard sizes (collar ranging from 36 to 46) we cannot obviously guarantee a perfect fit. We therefore recommend for your own satisfaction to collect your personal measurements.

Please also beware that two shirts ordered at different times might differ slightly. One reason is that we are always striving to improve our products and designs, another is that colors might differ slightly (even with modern dyeing techniques different rolls might have somewhat different hues).

6. Satisfaction and warranty

At The Tree Shirt what we value the most is your satisfaction.
You can return your product at our expenses if what you receive does not correspond with what you ordered in terms of style, measurements and details.
We will offer you a new product free of charge, shipping costs included, subject to the verification of the non – correspondence between your order and final product. A product is considered correspondent  if measurements, style and details match your order. Once we have verified the non- correspondence  we will also refund you of all shipping costs, as long as you send it via ordinary post.
As well as, according to Italian law concerning mail order selling (D.Lg. 50/92 and D.Lg. 185/99 ) you have the right to recede from the purchase by sending us a registered letter within 10 days from the date of the goods delivery.
This right does not apply for custom made goods like tailor made shirts,  as these are produced specifically according to your requirements. Please consider that the process of making your shirt starts right after you finish placing your order, and that obviously implies costs for our company.
Any attempt to abuse our services will be prosecuted to the maximum extent possible under Italian law.  

7.  Shipping/Delivery

All our products are normally delivered to your mail box within 4/5 weeks, but we cannot guarantee that. There may be circumstances when the actual delivery is delayed by a few days.
Your orders may also come ready in a shorter time, and we obviously strive to respect the 4 weeks schedule.
We always only charge you for the shipping of one item.  For instance, if you order 10 shirts the shipping cost will be the same as if you ordered one shirt, we pay any additional cost.
To deliver our products we have chosen Swiss Post  (which may rely for local shipping on DHL, UPS or Skinnet, depending on the area), a courier that enjoys a worldwide reputation  for punctuality and reliability. In case you are not home at the time of delivery they will try again 2 more times, and after that your purchases will be kept in their nearest courier office ,  for pick up at your disposal. 

8. Personal information

Your privacy is very important to us. We do not disclose any of the information that you provide us to third parties. At any time you can access and modify all your personally identifiable information that we collect on-line.

9. Force Majeure clause

In case of force majeure the agreement can either be considered as judicially cancelled with neither customer nor The Tree Shirt being entitled to any compensation or the delivery time(s) can be extended  as a result of the force majeure.
All events and circumstances that are beyond our control (such as but not limited to war, terror acts, strikes, transport obstructions, measures of commercial policy, new or amended legislation,  late delivery of raw materials by suppliers) are deemed  force majeure causes.

10. Ownership of Content

The design of this Website and all of its materials, including, but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, designs, video, audio, and written and other materials that appear as part of this Website (collectively, "Content" ) are protected by international copyright laws and other laws and treaties.
We take pride in our brand and do not condone and will not tolerate any unauthorized use of our trademarks, trade names, logos, names and trade dress (collectively, the “Trademarks”).
